Cheated by Ebay seller

There is the possibility that the shipping label was put on the wrong package. I work for a place that ships thousands of orders per year, and stuff like that happens sometimes.

Did the same guy list Nokia cases? Or Snickers bars?:scratch2: That's unlikely but mail theft is definitely a possibility too.

I do find it odd that he says he is a "police officer". Not that police officers can't sell phones on ebay, but it just seems way too convenient.
 
Sachin, I would keep all emails so that you can have everything you need. If he continues to send emails that are using the notion of his job to bully you it's not professional. He can open all the cases he wants and it could end up that he really sent the phone, and you really received the snickers and Nokia case. Regardless of what happens mean while be sure to keep "Everything" as you got it. Also if the ESN number was recorded you can simply advise that if it's activated under another number that would be most likely the individual who stole it. However if the thief is somewhat smart they could have peddled it off to another unsuspecting sole for three times it's value. I would if eBay inquires about the problem advise that your willing to give them anything they need including the package you received. I've had some decent luck with the resolution center who paid for the packaged to send back. I can't say they could or will but it could be likely.

Hopefully you get this resolved and I understand you frustration, most likely the "police officer" will inquire about tracking the ESN number to prove if it's activate or not and where. I would do the same as it would prove that if it's outside of the country and in the one I mailed to then I was able to keep up my end of the agreement for shipping.

Don't know what to do.I think I have just lost $160 and its a big value to me as my financial condition is not so good now a days.

I had ordered this phone for my friend as he doesn't have an Ebay account.I am in a deep trouble now as I had to refund money to my friend.

I've heard of this happening before, and even had an iPod touch taken from a package sent to me from Apple here in the States.

If the seller has good feedback, I would probably not suspect them.

Do some investigation - where was the Snickers bar from? Inspect the package -any sings someone has cut the tape with a stanley or xacto knife?

Even I am not 100% sure as seller is having 100% feedback and promptly replied all my mails before this has happened.He never asked me to pay by any other method or deal outside of Ebay.he many be honest .I don't know. what to do next.One thing is sure I will never use postal service again.

I think you are a victim of mail pilfering in your home nation.
The seller had good feedback- why would he go through the hassle of shipping a
chocolate bar to scam a measly $160.
He would also be aware that his paypal monies would be taken if he mailed you this.
It happens in USA too. I shipped something from NJ to midwest via parcel post in 2006 and the us mail subcontractors stole the item from the box, taped it shut and delivered it empty ! I found out later that parcel post has nowhere near the security as priority.

You will likely win a dispute in paypal as the seller will have no way of proving what he mailed, but I doubt He is the scammer in this case. Just my op. of course.
That's what came to mind here too. In any case its important to open a claim asap.
 
Paypal put funds on hold for a period of time, 20 days I think ...open a dispute immediately and then try to escalate your dispute to a claim. Hopefully you can get your money back.


If it turns out the seller was not at fault he should at least offer a 50 % refund so you both take an equal loss.
 
The assumption has been made that the seller cheated the buyer. I think it is more likely that the package was opened somewhere in transit and the goods removed. But, that's what insurance is for. Good luck, I'm sure the claims process will be painful and lengthy.
 
Ebay SHOULD be able to resolve this along with Paypal. Keep after them so it's not dropped. Also, what kind of IDIOT sends an I-Phone in an envelope? That is what he said in his email to you and for that he IS AN IDIOT. At first I thought he may have gotten his packages mixed up when he labeled them, but now it sounds like a scam. I am willing to bet the whole $160.00 he's not a police officer either, just a bullshit artist, assuming you are legit about everything you have told us.
 
Take pictures as evidence and contact Ebay customer service immediately. I doubt that the guy is really a cop. But it does make a person wonder when the seller has a 100% rating. Let him know that you are not scamming him and that he needs to do whatever he thinks is right on his end. See if the package was insured. Not much else that you can do right now except for letting the process work. It does sound like maybe somebody saw that there was a phone in the package and opened it up for a quick swap. If that is true then they have probably activated that ESN.

Thanks for your kind reply.I have read feedback of the seller its 100% +ve,so I paid him.This is first time I have encountered this problem.You are right, seller should not use envelope for Iphone.On close inspection I have found that someone purposefully tear or rubbed custom declaration which is pasted on the envelope,so its is not at all visible,I can barely see only value ie $160.Indian customs also did not charge any custom duty on this parcel,which also shows malpractice.I am in total loss.

If there isn't any party that makes this right for you, I'm seriously going to swear off ebay for good. I hear so many complaints these days. More and more people are getting ripped off. I know it's not ebay's fault, but scammers are flocking to that site.

YEs,I agree with you.I will never buy any high price thing from Ebay.It is very frustrating,I did not get sleep whole night.

Sachin, you keep saying you don't know what to do, but you have been told exactly what to do, several times.

1. Open a dispute with eBay/Paypal stating that you did not receive the item you purchased. Your money should be refunded.

2. If the item was sent "Insured", ask the seller to file a claim. Tell him, politely (since it appears he is innocent) that you have filed a dispute with eBay in order to protect yourself, and he should file the insurance claim to protect himself.

3. I would have to agree with several of the members who have posted here that it appears the item was open and the item taken by someone inside India Post.

4. In your last post you stated "I will never buy any high price thing from eBay". Keep in mind, eBay doesn't sell anything. You bought the phone from the seller, not eBay. Second, it appears the item was stolen inside India. That's neither eBay's fault, nor the seller's fault. Third, the item should have been insured in order to protect both you and the seller in exactly this circumstance.


Please let us know as soon as you have filed the claim with eBay. Good luck!
