Not quite sure about what to do with this ebay seller...

OK I won this auction back on the 1st...

Seller told me he was going out of town and would ship when he got back (June 20th) and email me tracking number. Told him that was cool.

Well I didnt hear from him when he got back so I emailed him. I got a message back and he told me he was real busy and wasnt able to ship the cassette deck upon arriving home but told me he would ship it on the 23rd

Well he didnt ship it but he did email me apologizing about things coming up and he then told me he would ship it the 26th for sure and he would give me the tracking number. Well he didnt. I have sent him 2 or 3 emails since Monday and havent heard from him. What do you think?

Report him to eBay through the appropriate channel(s) and call your credit card company to stop payment (hopefully you use AMEX for your PayPal account). If he can't meet any service standards because he's too busy, he shouldn't be attempting to run an eBay business in addition to whatever else it is he's doing. :nono:

It can seem harsh, but will get his attention and protect your money. I had a situation with a seller a while back, where I tried to be the "good guy"-he said he was sick/in the hospital, etc. Whether he was or wasn't he kept my money and did not send me my item.
Closed his ebay account and that's it. :thumbsdn:

Get the dispute rolling and see if this gets his rear in gear.
I think if you apply the reasonable standard(what YOU would do in the same situation)it makes more sense.

Thanks for the good advice, should I email him giving him fair warning about what I am about to do? After I start with the dispute is it possible he would still send the cassette deck? At what point should I call the credit card company and have the payment stoped?
 
I think you have given him warning, several times. I hope things work out and good luck

edit - pretty deck :yes: I hope you get it but judging by repairs written about it could be both good and bad

If it were me I would go ahead and start the dispute process. Sounds like you have already emailed him 4-5 times-the last 2-3 w/ no response. :thumbsdn:
He could indeed send the cassette deck/you receive it/then withdraw your dispute. :yes: If you paid through paypal this will go through them.

You might want to hold off with the cc company till you get a feel for how it's progressing.

You should be able to get the sellers phone number through Ebay. I would definitely try calling him first. When you request his phone number, a message is automatically sent to the seller advising him/her that you're requesting that information. That might motivate him to contact you after he sees the message from Ebay.
I went through a similar situation and just received an item I won back on May 30th. My check cleared on June 7 so it took the seller three weeks to get the item to me. I e-mailed him several times and called him and left messages three times. I was going to start the dispute process this morning but luckily the item finally showed up yesterday afternoon. Needless to say, my patience was wearing very thin by the third week.

I'll say this, once you win an item on ebay, there is a time limit. Once elapsed there is no recourse...
 
Had the same thing happen...

in February on an SAE tuner. The gal kept stringing me along for three weeks. Many, many emails later< I told her I would file a dispute for non-delivery of goods. The next day I followed thru. EBay/PayPal shut down her PayPal account, which in turn froze the bank account to which the paypal account was tied to. THAT got her attention. It took six weeks but I did get my tuner.

Well I filed the "item not receive" dispute yesterday evening last night. I then emailed the guy about shipping again. Today I got an email from him... reads as follows:


Hi,
No, I didn't, and I'm very sorry for that. I know I said I'd get it out and I intended to.
I have been so stressed out trying to get rent together for tomorrow that it's been
killing me. I know it's been a while and I didn't mean to ignore your emails.
I will get it shipped out Monday for sure and you will have it by the end of the week.
Again, I apologize for dragging it out like this. I don't mean to keep you waiting.
Well, I hope you will forgive me for my slowness and I'll do a good job of packing it.

Again I have heard this same story before. Should I wait until Monday to do anything else about it. Like I said I did file the claim so...

Deadbeat EBAY sellers

Hopefully you paid with Paypal. This gives you additional leverage, but you have to be careful of the calendar. Regardless, do all youself to be strung along past the 30-day/Paypal and 45-day Ebay "item not received" claim. And whatever you do, leave negative feedback. Otherwise, the one-sided auction model heavily weighed in favor of sellers (the ones who pay the Ebay sales fee).

You can see the last email I received from him on the first page of this post. He promised shipment this last monday. Well he hasnt contacted me since then, none of my emails have been returned. WTF is this guys problem. Although he only has 19 transactions with 100% feedback I seem to be getting **** on. I filed an "item not received" complaint against him last week and told him that this is taking way to long and if he doesnt ship it this week I want a full refund. He has even sold items after I won my auction and those buyers have already received there product with satisfaction and left him feedback. Its a damn shame because I really want that cassette deck but I dont think its worth holding out for any longer. I will be calling the CC company tomorrow.

Did you pay with Paypal? If so, file a dispute with them as well.
Channel your frustrations into getting a refund. It's a bummer, but it WILL get his/her attention.

A quick look at the sellers feedback indicates he shipped out a bunch of stuff during the aforementioned time frame. Do as others have stated, start the dispute process now before it's too late.
