Crappy neighbors

When I was in my mid-20’s, I lived in an upstairs apartment. Had a woman and her grown son living under me.

We’d absolutely crank the music at times. She/he got to the point that they would use something to bang on their ceiling. One night, they hit it so hard, that it jumped the tonearm off the record:D

The poor woman. My 60 something self thinks back on how inconsiderate my mid-20’s self was.

Unfortunately that me be true. But we already had to deal with this somewhere else. Now it is happening again. That is the problem. Management needs to get tough with the guy. And in this city if you move you may just have to deal with it all over again. Too many do nothing managers.
Another solution would be to move out of that city. It really comes down to the fact that full scale audio systems, home theater systems, and people that demand extreme privacy will never be compatible with apartment buildings. Having the ability and freedom to crank our systems to whatever volume levels we want without repercussion, remains part of the American dream.

Update:

As I was falling asleep or was already asleep last night I heard the phone ring. This was at midnight last night. It was the PD of course, calling me beack some 15 hours after I made a noise complaint. I did not answer or listen to the stupid voicemail. What's the point? The cops are useless here.

You need to make constant (DAILY) complaints to management as well as calling the police each and every time this new neighbor is disturbing the peace past 10pm. Every time.

How large is your complex?
Get other tenants involved in making the same complaints.
Get a petition signed by as many other tenants as possible, stating that all of you will refuse to pay rent until this clown is evicted.

Get the village to run the idiot out.

And rent Pacific Heights

Just waiting today to see when management is going to call me today. I am up early this morning. And it was a joy to wake up and think that now I get to deal with this nonsense all over again. I am going to make it clear to management that this is rising to a leve where I am both considering moving out and taking the guy to court if nothing changes and I have to stay here. I truly wish that it was easy to just find another place. Because I swore that I was not going to sign a lease here again and then when I went looking at other places I realized that there are a lot of places that are a complete ripoff in this city. So you just kind of have to aim for somewhere that is tolerable. Colorado Springs sucks these days. It has gone downhill since I moved here in 1995. Potholes, slumlords and idiots...

Thanks to either George Carlin or Jerry Seinfeld, I've been calling apartments "togetherments" ever since I heard that.
MUCH better descriptive title.

In my 20's, I was the maintenance man at an 80 unit complex for about 2.5 years.
Those were frame construction, and I swear i am not making this up.....the walls were so thin and poorly insulated that you could her your neighbors fart and sneeze.

That said, I've never lived in a togetherment unless you count the time when I was 2.
...and lucky me, the two worst neighbors I've had were-
1- the lady that was a traffic light maintainer for the county that parked her county diesel truck 12 feet from my bedroom, and started it at 5:00 am to let it idle for 1.5 hours before she left for work. I got up at 6:00 and had to be at work by 7:00. Typically leaving the house around 6:40. Frequently that truck was still idling when I left. Kinda pissed about being woke up an hour early, and also because those were my tax dollars.
2- the preacher that moved in next door and was constantly right outside my back door. Not once or twice a week, but dang near every single time I went out back. Different house on a 1/2 acre lot. Not sure what he was doing, but come on, you're outside, and at the closest possible position to my back door.....every single time I walk out my back door? This same guy- I had removed the gate from my driveway to the back yard in order to allow a wide trailer to get back there.....The neighbor, has an electric gate that is supposed to have a rubber pad to cushion the impact when it shuts. One Saturday morning about 6:00 am, I woke up to that gate slamming and rebounding against the closure. Obviously the rubber bumper had come off. Then not 5 minutes later it happened again...and again. The master BR in that house is on their driveway side. This kept going on for about 1/2 hour. SLAM, BANG, Bang, bang. SLAM, BANG, Bang, bang....about 3 times every ten minutes. After the 30th time, I got up and went out side. I see they are setting up for a yard sale. I politely say that the slamming and banging is disturbing my wife, who is trying sleep at 6:30 am on Saturday, and suggest that A- the rubber has come off and needs replaced, and B- I believe you could prop the gate open. In stead of apologizing (remember this guy is a preacher), he immediate snaps- "are you gonna' fill in that hole" motioning to the hole, on my property, where the gate post was. I was a bit in shock, as I certainly didn't expect immediate retaliation to a neighborly request to act...well, neighborly. Thankfully a short while after that yard sale, they moved, citing inability to make the payments (I didn't ask, he volunteered).

I asked the neighbor if she wanted to call the cops yesterday and she said "No". She will complain about the guy but calling the Po Po seems like a step too far for her. She is just too damn nice it seems. And I respect that. But it might have been nice to have another call in. But, yeah the cops are 100% useless here and everyone knows it. Their motto is basically "We don't show up when you call us"...

This is in the lease...

Tenant shall show due consideration for others and shall not behave in a loud or obnoxious manner, interfere with, disturb, or threaten the rights, comfort, health, safety, convenience, quiet enjoyment, and use of the Premises, by Landlord, or by Landlord’s agents or employees, other tenants and occupants, surrounding neighbors, and any of their guests, invitees, or the general public (collectively “others”).

Tenant agrees not to permit, commit, or suffer any conduct, disorderly or otherwise, noise, vibration, odor, or other nuisance whatsoever
about the Premises, having a tendency to annoy or disturb others and to use no machinery, device, or any other apparatus which would
damage the Premises or annoy others.

Section 1.12 of the lease. Didn't have to dig into it too far to find it. There is no mention of time there at all and his behavior is disturbing to the neighbors regardless of what time of day it is happening. The loud music yesterday was at around 9:15 AM. My son was still sleeping. He sleeps in a bit more than me but that is OK. He has trouble sleeping sometimes so he gets it when he can. Unless of course the neighbor is dictating when we are allowed to sleep. It's a clear lease violation no matter what...

And the thing is that we are somewhat used to all of the apartment noises. The people who were in that apartment before this guy were a bit loud as well. You could tell when they were watching TV or listening to music. But it never got that loud. We learned to deal with it. When they moved out we were happy. Then this guy came along. LOL. Management really needs to read new tenants a statement of some sort clearly saying that loud disturbances will not be tolerated. It's in the lease but of course most people don't even read what they are signing. I do. I read every word on every page...

The neighbor upstairs has a dog that runs around and you can hear that all of the time. But that is just background noise at this point in time. I think that guy also allows his dog to go piss on the balcony. Now that is going to smell wonderful over time. Good thing we don't use our balcony.

Sounds like you have it in for the police. All they can do is ask the tenant to turn the music down, and that's usually just a temporary reprieve. Your only viable chance of retribution is through the apartment complex's management. That's who you should be complaining to and also about. If they don't do anything about it, take them to court or move.

you can be ticketed for disturbing the peace.

multiple infractions can be filed as disorderly conduct and you can go to jail.

i was once ticketed for a buddy's car stereo system because it was in my driveway.

I think that's a different type of case. Since the excessive noise was coming from outside the residence and could be easily heard throughout the neighborhood, it would probably fall under the city's noise ordinance like GChief said.

When I would respond to noise complaints calls often they were not breaking the noise ordinance, they were just annoying the people that called so no tickets/summons issued.

Of course, the complainers never liked that answer.

When I have had the bad luck to live in a city apartment instead of my normal country living I looked for this style. I usually got a multi story apartment or condo. If they were designed right they would not put the neighbors bedroom area above the recreational area where stereos live. You would have two or more floors in between. Not perfect but it got the wife and I through a period where we practiced dancing for an event that could have riled many neighbors in a differently designed apartment.

If you're going to sue anyone, maybe it should be the management company for not enforcing the terms of the lease...
We will see how this plays out. But yes I will mention to them that they are responsible for enforcing the terms of the lease. If they do not do that then I would definitely have a case against them. Will talk to my property manager later today when she calls me (or I call her)...

I definitely don't "have it in for the police". Everyone in this city knows that they suck and you are lucky if they show up when you call them. A friend of mine had his truck broken into. He called the police about that but they did not show up. The only things that they will show up for are domestic violence calls or report of a weapon.
