Sold an amp & preamp on e-bay to a person who say's "they do not work for me". These worked 100% when I sent them and they were packed extremely well. He doesn't elaborate on " not work" I think this is the same person who asked for the dimensions before the auction ended. This is also his very 1st transaction on e-bay. I e-mailed him and told him that I will not refund his money if I receive them back and they are not working. What recourse do I have if I receive them back and they are damaged and not working? I find it impossible to believe that both amp & preamp don't work. Also, e-bay has billed my Discover card for the sale. Any advice would be appreciated. It's really leaving me with a bad taste in my mouth if I have to refund this money and my equipment was damaged by him.:thumbsdn:

Almost sounds like they "don't work" as in they are too big for his rack or he doesn't like the sound or something like that. Most prople would just say "They don't work" period if they were inop.

Final warning: All of the anti-eBay rants that gave ZERO answers to the OP's question have been deleted. If you intend to post in this thread and your post does not specifically answer the OP's question, do not post.

Last chance.

To Mike:

I'm confused as to your statement that eBay has charged your Discover card. For what? You were the seller, not the buyer. Has the seller already filed a dispute? Have you responded to the dispute? What is the current status of the dispute, if there is one?

The first thing to do is to ask the buyer what he is concerned about and what he wants to do. Do the items not function? Has he decided he simply doesn't want them?

We need more information before we can help with your situation.

What do you mean ebay has billed your Discover card for the sale? Are you saying the ebay fees are billed or are you saying a refund to the buyer?

Regardless, don't make ultimatums that only aggravate the situation. There will be time enough for any dispute handling without defensive rhetoric.

You want to hopefully see if you can work it out peacefully, if you haven't burned those bridges.
Have you asked him what he means by "does not work?"
Check to see if it may be as simple as wrong settings or connections.

Ask for pictures of any damage to gear or box and whatever else you need for claims if insured.

Always good to have pictures of gear working with lights/meters, serial number and of packing before shipping. Worst case, would be if he bought it to scavenge parts.

If you find out it was a scam, then rant.

He means that eBay charged his Discover card. Everyone on eBay that sells now must have a 'backup' card that will be charged for the full purchase if the buyer has a problem. This is part of the Buyer Protection Policy.

You can't do much. The only thing you can do is wait to get the gear back, hope it works, and then re-post it. That's the game.

Good Luck and I hope it works out well.

That's why it is getting difficult to sell stuff. I do not sell to anyone anymore with less than 20 feedback, period.

I have had a similiar issue before, however in this case I would contact ebay customer care and explain the situation. I personally have to agree with another AK'er that was taking pictures of the internals and serial numbers to prevent from swapping out pieces and declaring the item broken.

I have found that when I had a buyer complain about an item not working, I first contacted them and offered my phone number directly. I then asked them t define what was " not working" in detail so I could address the issue. Then I moved to ask them what they wanted to do, if the problem was something I could address or if it was obvious that it was a lie. When the buyer advised they wanted a refund and shipping returned I advised that the item was documented and recorded as working, all proof would then be submitted to customer care to be reviewed. Needless to say the information was enough to close the case in my favor and postive feedback was left.

I can't say this will always happen, but I believe that the more you take the lead of attempting to address the issue with the buyer, the better the outcome in the eyes of the customer service. I also felt that talking to them directly yeilded a better response verses letting the issue ride out on messages and exchanging of the facts.

I know that Jim on AK has taken an extra step as have I about recording the item functioning, then packing, shipment, tracking and insurance. This is extremely important especially with items that are of high value.

If you like you can PM me and I can try to help you, I'm sorry to hear you're having so many issues

Best of luck

Kevin

One lesson I've learned, very painfully, is contact ebay *before* the other party does. Make sure to address all issues up front and even offer emails or other correspondence to support your claims. The biggest issue with stating (if you did so) that the item works is someone will find a way to challenge this to get something for nothing, or back out of a deal because of their error.

In the case of damage I demand images of the item in the box (not removed). I had a buyer claim a receiver was destroyed in shipping. Asked for images, very specific shots. Received no response and no feedback. Worked for me. I have 100% positive and intend to keep it that way, but some people will test you, day in and day out.

Charging you back is the way of the land, but they don't do that right away so I'm wondering how much time has passed for you to bring this up? If you fail to act promptly you'll suffer the loss every time.

From what I have been reading, ebay selling has become a nightmare for sellers, even Paypal is anti seller these days. Seems to me that if I ever sold anything on ebay of an electronics nature, or anything that needs to perform a certain function, I would document it with a video in the listing of it doing its thing. This would prove to the buyer and anyone elde who needs to get involved (insurance claims, ebay Paypal, etc) it left my hands in good, working condition.

I would have him send me a video of him hooking it up and attempting to play it, or at least pictures of the hook up and control settings. If all else fails have him ship it back at his expense, refund the purchase price and if it works fine, post a neg and relist it with NO RETURNS allowed for any reason.

People...

I'm wondering if you can dispute the "charge back" by PayPal to your credit card? I know this sounds like furthur complications but sometime you have to "fight fire with fire."
I've sold quite a bit of great stuff on eBay in the last couple of years (all with 100% FB) but now I'm scared to death of getting caught up with their "scammer protection"
policies.

Contact ebay let them know what is going on. They will tell you a full line of crap that there is nothing they can do. Ask for a supervisor, they will tell you they do not have one (so nobody is in charge, maybe thats the problem over there). Make them aware that you will contact discover and dispute the transaction (discover and amex are "customer is always right"). You may get nowhere (I gave up this years ago). Welcome to selling on eBay, whats the buyers user ID? I would like to block him as a bidder so I dont end up in the same situation as you. I am finding this happens to me now one in 20 items, grin bear it and accept it (that is if you want to continue to sell on ebay). Fibally be fully prepared to get a broken preamp and amp that you wont be able to resell, and cover all shipping costs. Again, Welcome to selling on ebay. I am a 5 year ebay seller with 99.2% feedback 4.8 minimum dsr (some are 4.9 some days and 4.8 others) and have over 1500 feedback, I am restricted to only selling a certain number of items per month, because I am not a representative of eBays qualifications. IMHO fraudulant buyers are the problem with ebay, not sellers. Mini rant I hope it doesnt get this booted.

It is getting more difficult to sell on ebay. Now, the buyer is always right. Even when he is wrong he is right.

when selling advertise as lovely sounding don't put good working order perfect or other words like that . plus list as no returns then the buyer knows the deal .i have been selling a few amps on the bay lately no problems yet . as for your case you should have made immediate contact back and gone through how he was setting it up .if he was doing something wrong then help put it right if they have blown it up offer to repair at the going rate plus they pay shipping both ways .or they send it back and forget about it .

Silly person, even if you clearly place the term "as is, no returns, no refunds" you can still eat it. Ebay is GOD and partnered with Paypal they together will destroy all credibility in their used item buyers and sellers. Ive been forced by paypal to buy back several parts items, speakers that were sold as blown up: buyer claimed there were no good parts (wtf did he think blown up ment). Ive bought back DOA receivers that were sold as DOA. Receivers that turned on but didnt work and sold as so, returned because the buyer could not repair (it is complete bologna this company). You really just need to accept that you will be screwed and it will not go well some of the time. Buyers will find a way to steal from you every chance they get. Plainly stated if you want to sell on ebay you must abide by the same rules as everyone else, its a handicap that can be overcome with volume and smart financing (always be ready to buy back at least 20% of your monthly sales and keep that money and some extra for shipping aside and ready for quick release to avoid negative feedback, which could cripple your bussiness) Sorry if this is a rant but I am unsure if anybody understands the actual amount of fraud that happens on that site. I give ebay a negative feedback AND low DSR's for communication and customer service and buyer representation.

The op never came back, so he had no intention of actually asking for advice. And, as usual, this thread is circling the bowl.
