I'm not trying to debate. I'm just noticing that the legality of this ISN'T clear in this thread.
exactly, Kris. I am still not convinced....I am convinced it wont work on here...but I am not convinced that giving away the download is illegal.

Question: Would it be different in anyone's mind if the seller offered the following....

Vinyl LP $14.99
Vinyl LP with Digital Download Card $17.99

Yes it would be different. It would be now be criminal because now the seller is making a profit from something not rightfully his to sell. I've been in the engineering business for 40 years. If you have your intellectual property, your ideas, your creativity, trade dress - ultimately your livelihood you need to feed and educate your children stolen from you a couple of times this isn't hard to grasp. If a consulting engineer designs a control system for a single plant for an oil company for a fee. The oil company pays the fee and secures the right to build the plant one time and one time only. Even though the oil company paid the entire cost of the design they don't get to cookie cutter the intellectual property of the engineer any where else without compensating the engineer. If the customer wants to build multiples then a licensing agreement is required. Buying a record is a similar contract. You pay for one, you get one. You don't get to cookie cutter it all over the place even if you give it away. If it quadruples in value good for you. It's how it works. 1 = 1

I'm not following you bud. I don't disagree, I just don't understand where it is criminal for a company to sell an LP for $14.99, and to also sell an LP with a digital download card for $17.99.

I'm wrong about that. I was thinking if you kept the digital copy on your computer, but then the card wouldn't be unused anymore would it. I was tangled up in the technicalities, which is what lawyers are for. We're just splitting hairs because we can. Then again it would be fraud to sell a worthless download card if sold as unused :)

Once in a while I'll "share" music to turn someone on to something I love. By and large I pay for my music and encourage others to do so.

I would have to check with the lawyer on this folks. And for the record ( pun intended ) I have stacks of these unused DL cards that I will never use. Just don't do puter music much...

AK would like to stay far away from this, and we won't allow threads or posts offering 'free' music. The legal points on whether the download can be gifted or not would depend on the terms of the offer. If we were to support this, we could wind up with claims against us for every one that turned out to be wrong. We don't have the resources (or ability) to determine the right answer for every post, and honestly, don't want the stigma of accusations of being a piracy site, even if we could win the uphill legal battle.
