Bad Neighbor....HELP!!!!!!!!

:sigh::sigh:Another year and the TURD is still here :sigh::sigh:

Damn thing just won't flush!!!

Find a house with NO SHARED WALL. When the day finally you move, you can meet that turd and with a smile on your face politely bid farewell because you'll be moving to a nicer place than this. All perfectly legal. Who cares if she thought to finally be rid of you. You'll be happier.

I live in a house. I blare music at night (not often though) sometimes well into 6am in the morning. The only benefit was my living room is in the middle of the house. PLUS, next to a busy street so I got no complaints and my next door neighbor is great and says to others that I'm a good neighbor.

Many years ago I had a house next door to a duplex. One tenant was a waiter and would crank up the tunes every night at 3 AM and wake everyone up. One day I realized that the main power disconnect was within broomstick length of my backyard fence. After that, if the tunes blarred I'd march out to the backyard and throw the switch and his whole unit would go dark. I'd turn it back on when I got up in the morning. The jerk would complain to his landlord about power problems and never did figure it out. He moved when HE GOT TIRED OF THE BLACK OUTS. Morale of the story - Don't screw with the master of dasterdly deeds!!

Thanks for all the advice.....

Unfortunately I do not see moving out as an option right now for several reasons:

I OWN the house, bought it 8 years ago. I have fixed it up the way I like it, new finished basement, new heating system, new bathrooms etc.

I cannot get out from under the house at this time. I could NOT sell it for what I paid for it. I would be lucky to rent it for the mortgage payment, and HOPE she wouldn't give the renters crap and make them move.

If I walk away from the house, I am stuck back with apartments.
I don't know if I would be able to buy a house again in the future.
This is my first house which I bought FHA.

I move out = she wins.
I walk away from the house = she really wins.
I rent it she makes em move out = she wins.

For now the best thing I can do is stay here. I am glad that I did finish the basement when I did as I am sleeping down there. (I cannot sleep on the second floor at all.)

I really like the house, it suits me quite well and she is the ONLY reason I see to move. I have NEVER had troubles like this in the past 12 years of being on my own.

Thanks again for the advice.

Do you have any friends? If so, arrange for them to spend time with you at your house. If you want to try reasoning with the neighbor, do so close enough to your house that a friend inside can witness what happens. Forget witness, get them to videotape what happens. When you speak with her, have a mini recording device in your pocket. You need for it to not be your word against hers; you need for it to be your archived proof and your witnesses against her word. Once you have that, the cops are the way to go, her landlord gets money from her, and gets crap from you. Of course he likes her better, I would too if I were him.

Neighborhood watch officer/coordinator
District/neighborhood stabilization officer
Board of aldermen
Town council members
Newspaper/tv reporters
police officer friends
fire department friends
lawyer friends
civic leader friends
social worker friends
building inspectors office
civil code inspectors
neighbors

Have you sought out help from all of the above? You are only as powerless as you allow the situation to be. Quit being passive.

If YOU can't figure out how to get problem renters out of your neighboring unit, then you are also part of the problem. Go hire a real estate lawyer, draw up a battle plan, do exactly what they detail, and your problem will be rapidly solved. It isn't nearly as hard as you make it, if you do things the right way.

Your local real estate lawyer is a professional problem solver, has all the right contacts, and makes a living doing things the right way. :thmbsp:

I have a friend who is in the process of suing a fast food chain. He has collected all the evidence, got police and health department reports, medical bills, Xrays, etc. He contacted three local attorneys whom he has used in the past for other reasons. He figures with his medical bills, etc., the suit might be worth up to $50 - 80,000.00

They all told him he has a great case, but they weren't interested in it for less than a million.

That's cool. The OP just needs to find a Colorado licensed real estate attorney who will do it for less than a million.:thmbsp:

I had a friend with a similar issues. He was an audio engineer. Whenever he was not at home he would blast a 12khz or higher tone against the offending neighbor's wall at blistering decibels. It was a frequency too high to generally be audible but loud enough to effect the subconscious. It apparently drove them away in short order.
.....funniest thing I've heard lately.....

Well, OK. I'll put it simply. It's not worth your health and well-being to keep this up. Everything--right down to the house and its configuration--can be replaced.

I find it so very difficult to believe that absolutely no one is interested in doing anything, especially the police. At this point, based on what you say, they must know there is a problem here.

I don't mean to sound harsh or nosy, but there are good suggestions in this thread (and outlandish ones that should only be used to give a chuckle in a bad situation). Have you taken any of the good ones?

I wish you the best of luck, but you have to do something. Even if it is not what you really want to do.

I would be half tempted to try this.

So many thing going through my head. I feel bad for you. At least here in iowa there is a limit to complaints and the landlord has to evict them.

Maybe walk a skunk around on a leash and let it spray! Cars, house, anything not yours. Its your pet and it needs walked. "Its just marking its territory"

Yeah, until it decides you and your stuff are part of its territory!
:lmao:

The police will do nothing but talk :nono: and housing court judges are reluctant to evict people, even when they're deserving. Your a-hole neighbor knows this and that is why she continues to act the fool . Unfortunately, people like her will only behave when they're forced to behave :tears:, and that usually involves methods that are unlawful or violent.

Is it possible that you could get the state police involved (since the local police apparently don't care)?

We had a biker gang drug house a few doors over from ours, in a very quiet, respectible 50 year old neighborhood. They threatened to kill anyone who got up in their grill, and tried to intimidate everyone else. Bought a pit bull that had some attacks on the neighborhood kids, and passersby.

They ended up murdering a number of folks in bad drug deals. The county police wouldn't do a thing, and as a matter of interest, always wrote tickets and citations on the "normal" people involved in any incident. It rapidly became obvious at least a few desk sergeants were getting augmented pay, IYKWIM.

Although we kept bumping into the same police on the take locally, that was not the case in another interested jurisdiction, nor at the FBI or DEA.

You are only a victim if you choose to be, and you only STAY a victim if you do nothing but whine. A trip to the city hall to obtain the appropriate ordinance(and they likely are on-line,) a few directed questions to the diivision director(s) to find out how to process your incident reports in the correct manner, and take notes on who is accountable for you to get it done.

Local government is just like anything else in life - you will find a lot of people who don't like to be held accountable. The key is to find a few people in the right positions who want to be accountable in helping you with your situation, and do it the right way. At no time have I read that you have taken this approach, so it's time to start being personally accountable for this oversight.

Don't be treated like a chump - get to the right level where things get done - and then do everything the right way. A month of action is better than a year of whining about being a victim.

Whats the big secret, man? Just get a video camera and everytime you are being disturbed go film your encounter with her. Then call the cops. When they show up and of course she turns the music down show them the film.It will have the date and time on it plus the surly encounter too boot.If she goes beserk because you are filming her just keep in mind thats what you are attempting to show anyhow and you have the right to film anything that happens in public. She has no reasonable expectation to privacy when she is distrubing the peace.I think even in Colorado a homeowner has the right to "peaceful habitation" of his own property.
Film her, man! She wants to be a star. Can't you just see her in a nice orange jump suit?
Just film her.Nothing else.Only when she is in breech of the peace...wait...that sounds like Long John Baldry...but I digress.
Film her ten times in ten days.Be a gentleman and follow a narrow script.Do not provoke here because you are on film at the same tiime she is.Don't say anything...just film her.
Gather the evidence and then call the cops...again and again and again till they know you by your first name.
Work on it,man.Get her the hell gone...or live with it.

Seems it still essentially boils down to "he said, she said", and that's not much to go on for something as big as eviction/criminal/civil action, afaik.

It somehow needs to get beyond he said, she said for something to give, IMHO. And no, that's not suggesting any specific activity but merely a general observation.

As others have said, talk to an attorney -get a camera, start attending your HOA meetings and city council meetings and voice your concerns. Document the harrasment.
Stand up for yourself.

As to the POS who suggested ground glass for the dogs, no place for that anywhere!
