If I made the mistake the OP did -- what's stopping me from refunding the money and not selling the item?

Not the buyers fault they got a deal...
Buyer shouldn't be punished and have a contract/agreement broken for an error on the sellers side, IMO

I guess as much as there is "buyer beware" there is also "seller beware"

Ben

Is that what you would do?

Sure -- why not, if not prohibited from doing so..You have the right to remove an offer off the table if you're able to refund money.

I saw a Thorens TD-125 for sale for $50 bucks. The seller emailed me saying it was no longer for sale at that price as they didn't realize how much it was worth until after the ad was posted (craigslist). They created a new ad that reflected an appropriate value and the world kept on spinning.

How are they being punished if you can refund the money? Punished by paying a market price? Why should a seller be punished for making a mistake?

Great another one placed on my do not ever buy from or sell to list.

The reasons why not are many, first and foremost in my mind is that it is unethical to do so. Secondly once you listed it for sale at a set price you entered into a contract to follow through. Pricing it well below market value was not the buyers fault it was the sellers fault and the seller should be obliged to carry through.

Perhaps you have never heard the term a mans word is his bond? Obviously your word means nothing to you. If you would not keep your word and sell at the price you agreed to why would I ever trust you in any buying selling situation? If I sold you something I would be scared that you would return it with a faulty item and want your money back or something else along those lines. If I bought something from you I would be scared you would either leave out pertient information or flat outright lie about it to gain a profit. The seller failed to do his homework in this case a simple search on Ebay would have showed the proper market value he failed to do this search and the buyer should not be made to lose out because of it the buyer kept his end of the bargain and paid the price asked.

The thing is either your honest and you keep your word or your not.

Your integrity...

Once you accept the payment, the item is no longer yours, it's the buyers.

Interesting you post this in your tagline...

" I need to know what I'm doing right and what I could do better. "

Woah -- lots of assumptions there. You can easily find feedback here and I have posted my eBay information here, too. I am not going to spend a lot of time defending myself over your disconnected assumptions. I do not appreciate this attack and I will report it to the mods.

Sure -- why not, if not prohibited from doing so..You have the right to remove an offer off the table if you're able to refund money.

Here's the difference. When you offer to sell, and the buyer offers to buy, and money changes hands, you have a legal contract. Period. It is enforceable in a court of law, if it comes to that (I am not a lawyer, this is not legal advice). Many people disregard this and get away with it, but it does not change the law. Break a contract, you can be sued and lose. Your call.

I saw a Thorens TD-125 for sale for $50 bucks. The seller emailed me saying it was no longer for sale at that price as they didn't realize how much it was worth until after the ad was posted (craigslist). They created a new ad that reflected an appropriate value and the world kept on spinning.

Money had not changed hands, there was no contract.

A contracts consists of three things. Offer, acceptance, and consideration. The money part is the 'consideration'. No money (or other 'thing of value' such as in a trade) then no contract. You can't break a contract that does not exist.

How are they being punished if you can refund the money? Punished by paying a market price? Why should a seller be punished for making a mistake?

A seller is not being punished for making a mistake. A seller who has offered something for sale, received an offer, and accepted that offer by accepting the payment has committed themselves to a legal, binding, contract.

If they don't follow through with it, they are breaking the law.

And also they are an asshole.

My 2 cents.

Do whatever your heart desires. I never accused you of anything, you said you felt that that you should not be required to keep your word if it was going to hurt you finacially. I simply said that if you were going to be IMHO unethical on one thing I would be worried about you being unethical with other things also. How would I know what level of honesty it is you possess? Not that you would do any of the earlier mentioned things but I don't that, all I know is that if you are unwilling to keep your word on the sale then what would prevent you from keeping your word with other things too? See my point?

This is getting interesting! I have not send an invoice to the buyer, that's how it works in discogs. When someone place an order, i see the order and figure out the shipping (flat fee for domestic, and fees vary on international). So i am thinking here, i haven't take his money no invoice send, can i back out?

If you are a disreputable person, yes. An honest person would not back out, even if a contract did not yet exist. You offered, the buyer accepted. A decent person follows through on what they committed to do. Humanity 101.

But that is your call to make.

This was the point I was trying to make -- due to the technology involved no transaction has been completed -- the seller can back out of the deal. Humanity will not bat an eye. I want jameswei to eat a steak dinner tonight.

Gosh -- for all we know the buyer is Adolph Hitler's distant cousin and wants to profit off jameswei.

I think you can do whatever you like James but is your word only worth a few hundred dollars?

Thanks for reporting my post to the moderators SoundsAlike I am sorry you felt you needed to do this but you have to realize I am very passionate about honesty and integrity, it means everything to me.

Life can take lots of things from you your health your wealth and so on, one of the very few things you can keep until you die is your honor and integrity no one nor anything can take this from you it can only be thrown away by choice.

That's not what you said though. You can only refund money AFTER it's been paid. and if it's been paid the record is no longer yours.

If I made the mistake the OP did -- what's stopping me from refunding the money and not selling the item?

And so what if it's Hitler's cousin, Hitler, or another flipper? Your price was met and paid; the record should be shipped.

I have started a dialogue with you through PM to resolve this. I wish you would participate in that dialogue there. You personally attacked me and made several unsubstantiated claims. Remember, "All Audio, No Attitude"

I think most people in this forum is pretty well-off financially, so i think when you have money you care about intergrity and humanity. Just like class, how do you define class? Class is a by product of wealth.
When all you worry about is how to make your next mortgage payment or your next meal, do you really want to put humanity ahead of that? Sorry honey we miss this month's mortgage because i have intergity, or humanity. I think each person speaks differently in different stages of their life. 5 years ago $400.00 doesn't mean a thing to me, its like pocket change. In this stage of my life $400.00 means a lot. I got into records not because i am a collector, but i was told that there's money in it. You all can call me names or whatever you want, but i am going to tell the buyer that i made a mistake on pricing and he is welcome to buy it at a regular price.

This post defines humanity and integrity.

I'd argue fervently that "class" is most certainly NOT "a product of wealth."

That's a cop out, IMO
Plain and simple

I never attacked you, look back and you will see, all I said is I would be worried to deal with you if you were willing to back out on an offered deal and that I would be concerned that you "MAY" be willing to stoop to other things to ensure your financial gain, I feel I have good reason to be worried if this is the case at what price point $$ amount does honesty take over or lose out? How dishonest is dishonest?

I never said you have in the past nor will in the future be willing to do the earlier mentioned things only that if someone is willing to not honor their word because it gains them a few shekels profit then I would be concerned about other things also. Wouldnt you? If I offered to sell you something at a set price then failed to follow through would you trust me after this? There is little doubt in my mind if I did this to you, you would feel that I am not a person of my word and be concerned about my level of honesty in other areas as well

Interesting you post this in your tagline...

" I need to know what I'm doing right and what I could do better. "

Why is that interesting? Some people have had advise for shipping items, accepting different forms of payment, etc -- I value their input. Many people do not leave feedback and I hope that "tagline" compels them to do so.

Well this post has decided your fate as a seller here, from this point forward a lot of people will be unwilling to buy from you or sell to you because you are more concerned with profit then integrity. This may well cost you far more than $400.00 in the long run
