FedEx Max Liability = $100 ???

Please don't argue on my account. I do appreciate the suggestions, but I have to keep this above board. FedEx did indeed screw all involved, but I can't use that as an excuse to do it to them, as much as I'd really really really like to.

I didn't have a digital camera when I got this for Danamc, but I did take pics with a buddy's camera. This happened at his house and I sent the pics from one of his computers (he has four systems), since he needed the camera for something the next day and I just said 'screw it' and took the 9100 over there for pics to send to Danamc.

However, I don't remember taking any pics of the back. and the camera is very low-rez even if I did. Also, he works late, and I won't be able to see for myself till late tonight. I will go see if the pics are still on his system (should be...I still have a WinXP account on his computer that only I can access).
 
The laws are very confusing in this situation. Many states have laws that say that bonifide purchaser for value is the owner of the unit. Problem is proof of the term as to the buyer who shipped it to you. Also, you are now in the chain as to stolen property (assuming it is the unit you repaired). If you have a lawyer, you may want to contact him to see what the state laws are related to this so you do not deliver it to the wrong person. At issue is under some state law who is the actual owner of the unit? You should find out who to return the unit to. Possibly FedEx who has paid the claim is the owner of the property though since usually the owner who lost it as part of a claims settlement transfers his rights to the underlying property to the insurer.

Interesting situation but not a pretty one for anyone.
 
This is definitely a bizarre situation, EW. I don't know if my observations will help or not, but it seems to me that a few things need to be emphasized:

1) An amp of considerable value vanished while in the Fed Ex system, and was not delivered as promised. Thus, they ought to pay off on the insurance, so that whoever winds up short an amp is compensated.
2) You have an amp that you're morally certain is the missing amp, thus you have evidence plenty strong enough for you (and for us) that it was stolen and sold. But it may be hard to do anything with this evidence if it doesn't make the legal "beyond a reasonable doubt" criterion.
3) You need to protect yourself with respect to all concerned by documenting everything as best you can, including the actual value of the missing amp.

The advice to consult a lawyer seems good to me, and I applaud your effort to play this totally "by the book" and not give in to the natural outrage. Good luck!
 
I just got off the phone with the seller in Portland. Seems that he bought it from a pawn shop that sells on eBay (viking992).

Perhaps I haven't thought this all the way through, but the pawn shop should have some record of the purchase from the "seller." Check on that. Also, I agree with Skippy, a phone call to the police might not be a bad idea...

I'm sure they look alike anyway. Katie Holmes will play the love interest that EW falls in love with when he visits the pawn shop. The thief will be played by someone from Audio Asylum, or maybe a retired FedEx driver. The hard boiled cop investigating the case will be played by one of our own, Grumpy, since he has the perfect dispositon for that role, and we need someone in the film like Grumpy who has actual audio experience to advise Tom Cruise, " Damnit, that aint how you hold a soldering iron, Tom!".

Pawn shops are, in MO anyway, required by law to record pertinent information from individuals who bring in items to be pawned.

I'll make my first try at the pawn on my own. If they stonewall me, then I go to the police.
 
I can see it coming - a dirty old wrinkled London Fog, a Pugeot (sp?) 304 convertible and a basset hound. Oh, yeah, a cigar sticking out of the mouth.
 
Hmmm. dont know if lying to the fbi about the date is a super ideal? I have been involved with the justice system (unfortunately) and I have found that its quite alright for them to bend the truth but God forbid you do...they'll throw the book at you if they get wind. Perhaps keeping it at the fedex level would be the best solution. I bet they would probably be willing to work with you if you cordially explain how much you want to help them catch someone who is basically stealing from their company.
 
I always thought of myself more as a Colombo type. Any way to get Carmen Electra to play my trusty side kick :)

G., So here's the TV Guide description if I follow: you were looking into an inappropriately low FedEx reimubrusment for a lost amp, and unknown to you, it had been purchased on ebay by someone else, and then actually resent to you for repair, and sitting in your incoming items? You then found out that it was resold on ebay from a local pawn shop to the current owner, who has since sent it to you ?
Well, I guess the straightforward thing is return it to the original owner from who it was stolen. No other options come to mind easily, and I'd not want to get tangled up with any of the other players (pawnbroker, cops, thief, etc.) -sf

just trying to lighten the mood a little.

Here is an actual point ,, how about Small Claims Court cost about $75 file and FED-EX isnt going to waste time going to that court.. hopefully a valid point.

Katie is 26, and Tom is 43, just got engaged to her, not that I follow that stuff that much, but TV is saturated with it to the point of nausea
