Ebay's hands may be tied if the labels are not copyright protected. At the very least I would think the McIntosh logo on the labels would be protected.

It may not be all that simple. For example, when companies make key fobs with the car maker's logo, does the same principle apply? I certainly don't endorse what the seller is doing here but there may be nothing Mc can do about it. Sounds like Mc needs to consult a specialist in trademark law.

Yep. I have a very rare BMW-logo horn button for a MOMO steering wheel. BMW sent them a cease-and-desist when they had been in production for less than a year, and they were unable to reach any sort of licensing agreement.

Mc can do everything about it. It's no different than when the police raid and shut down a store selling counterfeit clothing.

I should point out that this is more of a trademark law issue than copyright, though the design of the tag might well be covered under copyright law.

Most likely they'll simply hit the seller with a C&D letter, and if the seller complies, that will be the end of it.
